Security on September 18, 2021) Chapter I General Provisions Article 1 In order to regulate the identification and handling of violations of rules and regulations in the recruitment of civil servants, maintain fairness and justice in the recruitment of civil servants, and strictly control the entrance of civil servants,These Measures are formulated in accordance with the Civil Servant Law of the People’s Republic of China and the Provisions on Civil Servant Recruitment and other relevant laws and regulations.Article 2 These measures shall apply to the determination and treatment of the violation of rules and regulations by applicants and staff in the recruitment of civil servants.Article 3 The identification and handling of violations of discipline and regulations in the recruitment of civil servants shall be based on clear facts, conclusive evidence, standard procedures and accurate application provisions.Article 4 Departments in charge of civil servants, recruitment organs, examination organs and other relevant units shall, according to their prescribed functions and powers, identify and deal with violations of rules and regulations.Chapter II Handling of Examination Applicants’ Violation of Rules and Regulations Article 5 Where the application materials or information concerning the qualification of examination submitted by the examination applicants are untrue, the recruitment organ or the competent department of civil servants in charge of qualification examination shall consider the registration invalid and terminate the recruitment procedures;Those who have maliciously registered and registered information, disturbed the order of registration or forged or altered relevant materials to obtain the qualification of registering for examination shall be cancelled by the competent departments of civil servants at or above the city level divided into districts and shall be restricted from registering for civil servants within five years.Article 6 of examination machine and other facilities and equipment used by the applicant;(6) answering the questions before the signal for the beginning of the examination is issued, or continuing to answer the questions after the signal for the end of the examination is issued;(7) Other violations of rules and disciplines with relatively minor circumstances.Article 7 applicants who have any of the following behaviors during the examination shall be disqualified from this examination and be restricted from applying for the examination for civil servants within five years by the competent departments of civil servants at or above the city divided into districts :(1) plagiarizing or assisting others to plagiarize answer information;(2) viewing or eavesdropping the written or audio-visual materials brought into the examination room in violation of the rules and regulations;(3) using communication equipment or electronic equipment with computing or storage functions prohibited from being carried;(4) carrying programs and tools with functions such as obtaining, recording, delivering, receiving and storing test questions and answers, as well as programs and tools specially used for cheating (hereinafter referred to as cheating equipment) that can avoid or break through the safety management measures against cheating in the examination room;(5) snatching or intentionally damaging other people’s examination papers, answer sheets (answer sheets), draft papers and other materials allocated in the examination rooms or examination machines and other facilities and equipment used by others;(6) taking out of the examination room such materials as examination papers, answer sheets (answer sheets) in violation of regulations;(7) Other violations of rules and disciplines with serious circumstances and adverse impacts.(1) taking part in the examination by forging, altering or embezzling another’s resident identity card, admission ticket or other supporting materials;(2) three or more people collude in cheating or participate in organized cheating;(3) taking the examination on behalf of another person or allowing another person to take the examination on his own behalf;(4) Using cheating devices listed in Item 4, Article 7 of these Measures;(5) illegally intruding into the examination information system or illegally obtaining, deleting, modifying or adding system data;(6) other violations of rules and disciplines with particularly serious circumstances and particularly bad impacts.Article 9 In the course of marking, if it is found that the contents of the answers given by the applicants in the same subject are the same and confirmed by the marking expert group, the examination institution that specifically organizes and carries out the examination will give the applicants a zero score in the examination of that subject (session), and the recruitment procedure will be terminated.The methods and standards that answer the same content are determined by provincial examination organizations.If the answers given by the applicants on the same subject are the same and there is other relevant evidence to prove the cheating, the applicants shall be dealt with according to the provisions of Article 7 and Article 8 of these Measures according to the specific circumstances.Article 10 Where an applicant conceals any disease or medical history that affects the recruitment or any other behavior that hinders the normal conduct of physical examination, if the circumstances are relatively minor, the recruitment organ or the competent department of civil servants in charge of organizing physical examination shall terminate the recruitment procedure;In case of serious and bad influence behaviors such as exchanging or replacing test samples, the competent departments of civil servants at or above the city divided into districts shall cancel their qualification for this examination and restrict their application for civil servants within five years;Those who collude with others to cheat in the examination or let others take the place of the physical examination shall be disqualified from this examination and be restricted from applying for civil service for life by the competent departments of civil servants at or above the provincial level.Article 11 Where an applicant engages in fraud, concealing the truth or other acts that impede the normal conduct of relevant work during the inspection, physical assessment or psychological quality assessment, and the circumstances are relatively minor, the recruitment organ or the competent department of civil servants in charge of organizing and implementing the application shall terminate the recruitment procedure;If the circumstances are serious and the influence is bad, the competent departments of civil servants at or above the city divided into districts shall cancel the qualification of the examination and restrict the application for civil servants within five years.If the circumstances are particularly serious and the influence is particularly bad, the competent departments of civil servants at or above the provincial level shall cancel the qualification of this examination and restrict the applicants for civil servants for life.Article 12 Applicants shall consciously maintain the order of civil servant recruitment, and shall terminate the recruitment procedure if they commit any of the following acts;If the circumstances are serious and the influence is bad, the competent departments of civil servants at or above the city divided into districts shall cancel the qualification of the examination and restrict the application for civil servants within five years.If the circumstances are especially serious and the impact is especially bad, the competent departments of civil servants at or above the provincial level shall cancel the qualification for this examination and restrict the applicants for civil servants for life.(2) refusing or obstructing the performance of management duties by the staff;(3) threatening, insulting, slandering, framing, or beating the staff members or other applicants;(4) seeking examination qualifications, employment opportunities, economic interests or other improper interests by transferring or exchanging interests;(5) purchasing cheating equipment listed in Item 4, Article 7 of these Measures;(6) other acts that disturb the order of civil servant recruitment.Article 13 Applicants who are suspected of violating laws and regulations during the recruitment of civil servants shall be transferred to the relevant state organs for handling according to law.If the applicant is a state official, he/she shall notify the unit to which he/she belongs of his/her violation of rules and discipline and the result of his/her punishment.Article 14 During the probation period, if it is found that the applicant has any violation of rules and regulations listed in these Measures, the recruitment shall be cancelled and the applicant shall be dealt with accordingly according to the relevant provisions of these Measures.Those who are found to have violations of rules and regulations listed in these Measures after grading shall be dealt with accordingly according to relevant provisions.Article 15 Applicants who have serious or particularly serious violations of rules and regulations shall be recorded in the archives of good faith of civil servant recruitment, and credit information sharing and other management shall be conducted in accordance with relevant provisions.Chapter III Handling of Staff’s Violation of Rules and Disciplines Article 16 In any of the following circumstances, the leading personnel and the person directly responsible shall be investigated for liability according to rules and disciplines according to the seriousness of the circumstances;(1) failing to recruit in accordance with the prescribed staffing quota and post requirements;(2) failing to recruit in accordance with the prescribed qualifications and procedures;(3) introducing or changing employment policies without authorization, causing adverse effects;(4) engaging in malpractices for personal gain in employment;(5) leaking test questions, violating examination discipline or other behaviors affecting fairness and justice.Article 17 Any staff member under any of the following circumstances shall be investigated for liability according to rules and disciplines according to the seriousness of the circumstances;(1) divulging examination questions or other confidential information about employment;(2) taking advantage of the convenience of work, forging examination results or other materials related to employment;(3) taking advantage of the convenience of work, assisting applicants to cheat in exams;(4) dereliction of duty that affects the normal conduct of recruitment;(5) other acts in violation of recruitment discipline.The fourth chapter illegal indiscipline handler article decision on handling the examination shall review the facts, reasons and evidence submitted by the applicant.Article 20 Where a decision is made on the handling of the violation of rules and regulations of the applicants, a written decision on the handling of the violation of rules and regulations of the civil servant recruitment shall be made and served by direct service, entrusted service, mail service or announcement.For applicants who are subject to a five-year restriction or a lifetime restriction, the restriction shall be counted from the date when the decision is made.Article 21 Applicants who refuse to accept the decision on the handling of the violation of rules and disciplines may apply for administrative reconsideration or bring an administrative lawsuit according to law.Article 22 Relevant units shall handle violations of rules and regulations of staff members in accordance with their functions and powers and procedures.If a staff member refuses to accept the handling of a violation of rules and regulations, he/she may apply for review or lodge a complaint in accordance with regulations.Chapter V Supplementary Provisions Article 23 Applicants and other personnel other than staff who interfere with the order of civil servant recruitment shall be dealt with in accordance with relevant laws and regulations.Article 24 These Measures shall be applied in reference to the determination and disposal of violations of rules and regulations in the recruitment of staff other than workers in organs (units) managed by referring to the Civil Servant Law.Article 25 The Organization Department of the CPC Central Committee and the Ministry of Human Resources and Social Security shall be responsible for the interpretation of these Measures.Article 26
